The MSP statute requires parties to personal injury claims of Medicare beneficiaries to protect the interests of Medicare.

  • Duty to reimburse any conditional payments made by Medicare related to the underlying injury
  • Duty to create a Medicare set-aside when required (primarily in workers' compensation cases).

  • We audit the conditional payment claim for accuracy and challenge any payments for unrelated treatment.

                          Medicare set-aside calculation and submission to Medicare for approval:

  • We review the claim file and determine the amount that Medicare will require for a Medicare set-aside.
  • We obtain approval of the settlement and Medicare set-aside from the Centers for Medicare and Medicaid Services.
  • We obtain a letter from Medicare showing any conditional payments made.
  • We audit the conditional payment claim for accuracy and challenge any payments for unrelated treatment.
  • We obtain a final payment demand from Medicare.
  • We provide our client with full instructions and guidance in closing the case with Medicare.
